1. Agreement
By accessing or using ChatOrder ("the Platform"), operated by Devzenix Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Service Description
ChatOrder provides a software platform that enables businesses to accept orders from customers via WhatsApp. The service includes:
- AI-powered WhatsApp ordering chatbot
- Menu management dashboard
- Order management and tracking
- Payment processing (via Stripe)
- Table booking system
- QR code generation
- Customer relationship management
- Analytics and reporting
3. Eligibility
To use ChatOrder as a business, you must:
- Be at least 18 years old
- Be legally authorised to operate the business
- Provide accurate and complete registration information
- Comply with all applicable UK laws and regulations
- Have a valid WhatsApp Business account (for ordering features)
4. Account Responsibilities
- You are responsible for maintaining the security of your account credentials
- You must not share your login details with unauthorised individuals
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorised access
- You may invite team members with appropriate access levels (Owner, Admin, Staff)
5. Payments & Billing
- ChatOrder charges a monthly subscription fee based on your chosen plan (Starter, Growth, Pro, or Enterprise)
- Customer payments go directly to your connected bank account via Stripe
- ChatOrder may charge a small platform transaction fee on each order (disclosed in your plan details)
- Subscription fees are billed monthly and are non-refundable
- We reserve the right to change pricing with 30 days' notice
- Failure to pay may result in suspension of your account
6. Acceptable Use
You agree NOT to:
- Use the Platform for any illegal purpose
- Send spam or unsolicited marketing via WhatsApp
- Sell prohibited items (weapons, drugs, counterfeit goods, etc.)
- Misrepresent your business or products
- Attempt to reverse-engineer, hack, or disrupt the Platform
- Use the AI features to generate harmful, misleading, or inappropriate content
- Violate WhatsApp's or Meta's terms of service
7. AI Disclosure
ChatOrder uses AI technology to process customer orders. By using the Platform:
- You acknowledge that customer conversations are processed by AI
- You understand that AI may occasionally make errors
- You are responsible for verifying AI-generated orders before fulfillment
- Your customers will be informed that they are interacting with an AI assistant
- The AI will never invent prices or products — it uses your menu data only
8. Data & Privacy
Your use of ChatOrder is also governed by our Privacy Policy. By using the Platform, you agree to the collection and processing of data as described therein.
As a business using ChatOrder, you act as a Data Controller for your customers' data. ChatOrder acts as a Data Processor on your behalf. A Data Processing Agreement (DPA) is available upon request.
9. Intellectual Property
- ChatOrder, its logo, and software are owned by Devzenix Ltd
- Your business content (menu, images, knowledge base) remains your property
- You grant us a licence to display your content within the Platform
- You may not copy, modify, or distribute ChatOrder's software
10. Limitation of Liability
- ChatOrder is provided "as is" without warranties of any kind
- We are not liable for any losses arising from AI errors, service outages, or third-party failures
- Our total liability is limited to the amount you paid us in the preceding 12 months
- We are not liable for any indirect, incidental, or consequential damages
- You are responsible for the accuracy of your menu, pricing, and business information
11. Termination
- You may cancel your account at any time from the dashboard or by emailing us
- We may suspend or terminate your account for violation of these terms
- Upon termination, your data will be retained for 30 days, then permanently deleted
- Outstanding fees remain payable upon termination
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
